Terms of Service
These terms govern your use of the 360SmartData website at www.360smartdata.com (the “Site”) and any related services, tools, or platforms we provide (collectively, the “Services”). By using our Site or Services, you agree to these terms. If you don’t agree, please don’t use the Site or Services.

360SmartData is a marketing technology company providing visitor identification, audience intelligence, and campaign activation services to B2B and SMB clients. References to “we,” “us,” or “our” mean 360SmartData and its affiliates. References to “you” or “your” mean the person or business accessing the Site or Services.

Acceptance of these terms
By accessing the Site, creating an account, downloading a resource, or using any Service, you accept these Terms of Service and our Privacy Policy. If you’re accepting on behalf of a company, you confirm you have authority to bind that company.

Eligibility
You must be at least 18 years old and have the legal capacity to enter into a contract to use the Site or Services. The Site is intended for business users; consumer use of identification or marketing services is not supported.

- Upload or transmit malicious code, viruses, or harmful files
- Misrepresent your identity or affiliation when contacting us or our clients
- Use the Services in violation of any applicable law, including privacy, consumer protection, and anti-spam laws (CAN-SPAM, TCPA, GDPR, CCPA)

Lead magnets, downloads, and gated contentn
When you submit a form to download a guide, report, calculator, or other gated resource, you authorize us to:
Send you the requested resource
Add you to the related email nurture sequence (you may unsubscribe at any time)
Contact you about related services that may interest you
Retain your submission data for as long as we have a legitimate business interest
You may opt out of any marketing communications at any time using the unsubscribe link in our emails or by contacting us at support@arsmartmarketing.com.

Intellectual property
All Site and Service content — including text, graphics, logos, software, data compilations, and methodologies — is owned by 360SmartData or our licensors and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission, except:
- You may save or print copies of downloadable resources for your own internal
- You may quote brief excerpts with attribution and a link back to the source page
The 360SmartData name, logo, and product names are trademarks of 360SmartData. Other trademarks belong to their respective owners.

User submissions and feedback
If you submit comments, suggestions, ideas, or feedback (“Submissions”) about the Site or Services, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use those Submissions for any purpose without compensation to you. Don’t submit anything you consider confidential or proprietary.

Limitation of liability
To the maximum extent permitted by law, 360SmartData and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, lost data, or business interruption — arising out of or related to your use of the Site or Services, even if we’ve been advised of the possibility of such damages.
Our total cumulative liability for any claim related to the Site or Services will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions don’t allow these limitations. Where applicable law prohibits limiting liability, the limits above apply to the maximum extent permitted.

You agree to indemnify, defend, and hold harmless 360SmartData and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

- Your violation of any third-party right, including intellectual property, privacy, or publicity rights
- Your violation of any applicable law

Termination
We may suspend or terminate your access to the Site or Services at any time for any reason, including violation of these terms. You may stop using the Site at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

Governing law and dispute resolution
